All alcoholic beverages sold through this website are deemed to be sold in the State of Tennessee, and title passes to the Buyer in the State of Tennessee.

Vitis 45 Select Imports makes no representation as to the legal rights of any person or entity to ship, transport, import, receive, possess, or consume alcoholic beverages in any state or jurisdiction outside Tennessee.

By placing an order, you represent that you are acting in compliance with your local and state laws regarding the purchase, transportation, delivery, possession, and use of wine or other alcoholic beverages. You are solely responsible for determining the legality and any tax, duty, or compliance consequences of bringing purchased products to your selected destination.

By placing an order, you authorize Vitis 45 Select Imports to act on your behalf to engage a common carrier to deliver your order to you or to your selected recipient, subject to applicable law and carrier requirements.

An adult signature is required for delivery of alcoholic beverages. The recipient must be at least 21 years of age and may be required to present valid government-issued identification to verify age and identity. Delivery drivers will not deliver alcoholic beverages to persons who are visibly intoxicated.

If you intentionally or unintentionally misrepresent your age, the recipient’s age, or any other information in order to obtain alcoholic beverages illegally or provide alcoholic beverages to a person under 21, we reserve the right to cancel your order, restrict or terminate your access to our website, and cooperate with law enforcement authorities.

We make every effort to provide accurate product descriptions, images, vintages, bottle sizes, pricing, availability, and other product information. However, product information may contain errors, inaccuracies, or omissions.

Wine is an agricultural product, and bottle condition, label condition, capsule condition, cork condition, fill level, packaging, vintage availability, and other product details may vary. Product images are for reference and may not exactly match the bottle, label, vintage, or packaging received.

Colors, labels, and product appearance may also vary depending on your device, screen settings, lighting, and image rendering.

We reserve the right to change product descriptions, pricing, availability, and offerings at any time without notice. We may discontinue any product at any time. We may limit quantities available for purchase by any person, household, account, billing address, shipping address, credit card, geographic region, or jurisdiction.

4. Orders and Order Acceptance

When you place an order through our website, you are making an offer to purchase the products in your order. Your receipt of an order confirmation, electronic confirmation, or payment authorization does not constitute our acceptance of your order.

We reserve the right to accept, decline, cancel, limit, or modify any order for any reason, including but not limited to product availability, pricing or product errors, suspected fraud, compliance concerns, shipping restrictions, carrier limitations, weather conditions, legal restrictions, or concerns regarding age verification.

We must receive and process your payment before your order is accepted. If your payment has been charged and we later reject or cancel your order, we will process a refund, subject to our Return and Refund Policy and any applicable cancellation or shipping fees.

5. Prices, Taxes, and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time your order is placed, subject to correction of errors.

Unless otherwise stated, posted prices do not include taxes, shipping, handling, carrier fees, insurance, duties, or other charges.

All wines collected or delivered are subject to Tennessee sales tax, where applicable. If Vitis 45 Select Imports fails to add required sales tax when an order is placed, we reserve the right to correct and collect any sales tax due.

You agree to provide current, complete, and accurate purchase, payment, billing, shipping, and account information for all purchases. You represent and warrant that:

You are authorized to use the payment method provided.
The payment information you provide is true, correct, and complete.
Charges incurred by you will be honored by your payment provider.

6. Shipping and Delivery

Shipment can usually be arranged within 7 business days after receipt of payment, but all shipping and delivery times are estimates only and are not guaranteed. Once products are transferred to the carrier, title and risk of loss pass to you, subject to applicable law and these Terms and Conditions.

Vitis 45 Select Imports reserves the right to delay shipment to protect product quality, including during periods of extreme heat, extreme cold, or other weather conditions that may damage wine.

7. Cancellations, Returns, Refunds, and Bad Bottles

Cancellations, returns, refunds, broken bottles, undeliverable packages, weather-related damage, and bad bottles are governed by our Return and Refund Policy, which is incorporated into these Terms and Conditions.

We charge a 15% cancellation fee for cancelled orders. Cancelled orders are orders that have been placed but have not yet shipped or been delivered.

We do not accept returns of wine distressed due to shipping, weather, heat, cold, rain, snow, or other transit conditions outside our control.

Corked or otherwise innately flawed bottles are an occasional possibility with wine. We are unable to guarantee wines that have been out of our possession for longer than 7 days. All bad bottles must be returned to Vitis 45 Select Imports for inspection before a refund or credit may be issued.

8. Personal Use Only; No Resale

You represent and warrant that products purchased through this website are for your own personal or household use and not for commercial resale, unauthorized redistribution, or export.

We reserve the right to limit or prohibit sales to dealers, resellers, exporters, buying agents, or any person or entity we believe may be purchasing for resale or unlawful distribution.
